Lohan Tells Pitbull: 'Give Me Everything'
Lindsay Lohan has sued rapper Pitbull for an injunction and damages, claiming that the hit song “Give Me Everything” tarnished her reputation by making a “distasteful” allusion to her arrest record.
Lohan has a real penchant for suing people.
Last year, Lohan filed a similar lawsuit against E*Trade, claiming she was defamed by a commercial in which a baby accuses her “boyfriend” of cheating with “that milkaholic Lindsay.” That case was reportedly withdrawn and settled for a confidential sum.
I think this case with Pitbull will end similarly; withdrawing for an undisclosed amount. When I first heard about this claim, I thought the whole song was about Lohan but her name is only mentioned once in the following lyric:
got it locked up, like Lindsay Lohan
It would be very hard for her to prove that Pitbull’s lyrics “greatly injured” her career and caused her “tremendous emotional distress” considering she has been imprisoned twice and been on house arrest once and following all those times, she still managed to find fruitful work as an actor. Last time I checked, stating a fact is not liable.
California Civil Code Section 46 states the following:
Slander is a false and unprivileged publication, orally uttered, and also communications by radio or any mechanical or other means which:
1. Charges any person with crime, or with having been indicted,
2. Imputes in him the present existence of an infectious,contagious, or loathsome disease;
3. Tends directly to injure him in respect to his office, profession, trade or business, either by imputing to him general disqualification in those respects which the office or other occupation peculiarly requires, or by imputing something with reference to his office, profession, trade, or business that has a natural tendency to lessen its profits;
4. Imputes to him impotence or a want of chastity; or
5. Which, by natural consequence, causes actual damage.
I believe only 1 and 3 apply in this case but, honestly, she needs to prove that what Pitbull said was false. Honestly, I’m surprised that she’s going through with this. Defamation is notoriously hard to prove and the payout is well… Not worth it.
